Effect Does Listing Have? |
When a building is listed it becomes protected by statute and it is necessary to seek permission in advance of carrying out works of alteration, both internally and externally, that affect its character. Listing covers both the interior and exterior of listed buildings regardless of Listing category; the fact that the list contains no detailed interior description does not alter this rule. Furthermore, any object or structure which is fixed to a listed building, or which falls within its curtilage and has formed part of the land since before 1 July 1948 is also considered to be part of the listed building. It is a criminal offence to demolish or materially alter or extend a listed building without first obtaining Listed Building Consent. The penalty can be an unlimited fine or up to 2 years imprisonment, or both.
Unauthorised alterations which go unnoticed, often come to light as part of the conveyancing of properties so it makes sense to take advice on proposed alterations at an early stage!
